व्यक्तियों की गिरफ्तारी से जुड़ी धारा

गिरफ्तार व्यक्ति की तलाश में ध्यान रखने योग्य बातें:-

➽ गिरफ्तार आदमी के पहने कपड़ों को छोड़कर शरीर पर के दूसरे सामानों को पुलिस अपनी अभिरक्षा में ले लेगी।

➽ कब्जे में ली गयी वस्तुओं की रसीद उस आदमी को तुरन्त दी जायेगी।

➽ किसी स्त्री की तलाशी शिष्टतापूर्वक किसी दूसरी स्त्री द्वारा ली जायेगी।

➽ महिला की तलाशी पुरूष पुलिस कर्मी द्वारा नहीं ली जायेगी।

व्यक्तियों की गिरफ्तारी से संबंधित धारा 

व्यक्तियों की गिरफ्तारी से संबंधित “दण्ड प्रक्रिया संहिता” की धाराएं हैं:-

➽ धारा 41 पुलिस द्वारा बिना वारंट गिरफ्तार करना

➽ धारा 42 नाम एवं पते बतलाने से इन्कार करने पर गिरफ्तारी

➽ धारा 43 साधारण व्यक्ति द्वारा गिरफ्तारी

➽ धारा 44 मजिस्ट्रेट द्वारा गिरफ्तारी

➽ धारा 45 सशस्त्र बलों के सदस्यों का गिरफ्तारी से संरक्षण

➽ धारा 46 गिरफ्तारी कैसे की जायेगी

➽ धारा 47 किसी स्थान में प्रवेश किए आदमी की गिरफ्तार के लिए तलाशी

➽ धारा 48 गिरफ्तारी के लिए भारत के अन्य क्षेत्रों तक पीछा 

➽ धारा 49 अनावश्यक रूकावट नहीं करना

➽ धारा 50 गिरफ्तार आदमी को गिरफ्तारी का कारण एवं जमानत का अधिकार बतलाना

➽ धारा 53 (क) बलात्संग के अपराधी की चिकित्सा व्यवसायी से जाँच

➽ धारा 54 गिरफ्तार व्यक्ति के अनुरोध पर चिकित्सा पदाधिकारी द्वारा उसकी जाँच

➽ धारा 54 (क) गिरफ्तार व्यक्ति की शिनाख्त

➽ धारा 55 पुलिस अधिकारी द्वारा गिरफ्तारी के लिए अपने अधिनस्त की प्रतिनियुक्ति

➽ धारा 56 गिरफ्तार व्यक्ति को मजिस्ट्रेट या थाना प्रभारी के पास उपस्थित करना

➽ धारा 57 गिरफ्तार आदमी को 24 घंटे से अधिक नहीं रोका जाना

➽ धारा 58 पुलिस गिरफ्तारी की सूचना भेजना

➽ धारा 59 पकड़े गये व्यक्ति को छोड़ना

➽ धारा 60 भाग जाने पर पीछा कर गिरफ्तार करना

Things to keep in mind while searching for the arrested person:-

➽ Apart from the clothes worn by the arrested man, the police will take other items on the body in their custody.

➽ The receipt of the seized articles shall be given to that person immediately.

➽ The search of a woman shall be done in a courteous manner by another woman.

➽ The woman will not be searched by the male police personnel.
